Terms of use
By using this Portal, you acknowledge having read and accept these conditions. If you do not accept these conditions, you are not authorized to use this Portal and must immediately stop using it.
You agree to use the Portal in accordance with applicable laws and regulations.
The Portal can redirect you to various separate websites and applications. These conditions apply only to the content of the Portal, and not to each website or individual application to which it is redirected. BDO accepts no responsibility for the content, accuracy or security of websites or applications linked (by hyperlink or otherwise) to the Portal.
We may revise these terms of use at any time in our sole discretion by posting these revised terms of use on the Terms of Use link (i.e. this page you are currently viewing) or elsewhere on the Portal . Such revisions will take effect against you upon their publication, unless expressly indicated by us. It is your responsibility to read these revised terms of use by consulting this page. Your continued use of Global Portal following changes to these terms of use constitutes your agreement to the revised terms of use.
The Client and the Client User are fully responsible for their use of the Global Portal and of the assigned usernames and passwords (if applicable). The Client User must use the Portal only with his own user name and password assigned individually or the user name and password granting access to the Portal. BDO and any provider and / or third party involved in BDO will not be responsible, or shall not be held responsible, for the use by the client user of the Portal or the use of the usernames and passwords assigned (if applicable). The Client and the Client User must in no case infringe the intellectual property rights of third parties and must in no case interfere with or commercially exploit the system of which the Portal is a part, except in the cases expressly authorized herein.
BDO and any service provider and / or third party engaged by BDO for the purposes of the Portal retain the rights of use and ownership of the Portal and the associated technology. You access this global portal using Microsoft SharePoint technology and by using this Global Portal, you and the customer agree to be bound by their license terms, set out here, as they may be changed from time to time.
The Client and the Client User will maintain the confidentiality of the content and technology of this Global Portal by using at least the same degree of care that the Client and the Client User use to maintain their own proprietary and / or confidential information, but in no case using less than a reasonable degree of care.
The Customer and the Customer User will ensure that all and all copies of this content (printed or electronic) of this Global Portal retain and / or reflect any copyright, confidentiality or other legal notice that appears on or with this material when accessing this Global Portal. The Customer and / or the Customer User will not copy, download, reproduce, modify or distribute this technology of the Global Portal in whole or in part, unless this may be expressly and previously authorized elsewhere in writing outside of these Conditions.
Unless otherwise provided in an applicable engagement letter, you and the customer cannot engage in any of the following regarding the Portal and / or its content, and you and the customer cannot authorize other parties to do so:
(a) use the service for purposes other than those for which access has been provided,
(b) copy or distribute the Portal or any of its content,
(c) modify or create an extract from the Portal,
(d) deduct, modify or modify the source codes relating to the Portal, or
(e) distribute, operate, transfer or sub-license the Portal or any related rights.
As a Customer User and Customer, you remain at all times responsible for the accuracy and completeness of the data provided to the Global Portal and for their timely submission.
If you and / or the Customer save information from the Global Portal on your own computer, server or other storage medium, you and / or the Customer are responsible and liable for the security, storage and availability of this information.
Global Portal Availability
If, for any reason, the Portal is not available for more than one day, you and / or the Customer must contact your BDO contact both by telephone and by e-mail and, if necessary, Other arrangements will be made for the submission, preparation and / or approval of documents so as not to prejudice any filing of documents in a timely manner or otherwise. If you and / or the Customer do not immediately contact BDO, BDO will not be responsible for the consequences of any late filing of documents or otherwise.
BDO is responsible for maintaining the technical and organizational environment necessary for the Portal and strives to guarantee that the information it contains is secure and accessible only to authorized persons.
BDO does not guarantee the permanent availability of the Portal. BDO reserves the right, in its sole discretion, to remove the Portal, either from you and the Client and / or in general, in cases such as virus attacks, Internet security breaches, problems caused by Customer connection problems or in other situations where uninterrupted use of the Portal is or may be threatened. As far as possible, BDO will inform the Customer in advance. If you and / or the Customer learn that security may be at risk, you must notify BDO immediately by telephone and in writing (including by e-mail).
BDO will inform the Customer in advance of any planned maintenance of the Portal.
Access to Global Portal
Client access to the Global Portal is governed by the Client's local member company.
To access the Portal, you and / or the Customer may have received a user name and password from your local member company. Username and password must be treated confidentially and are not transferable.
You and the Customer are responsible for the proper use and security of the Customer's hardware and software and user certificates providing access to the Portal. You and the Customer cannot authorize unauthorized parties to access the Portal. You and the Customer must use reliable and updated antivirus software before and during the use of the Portal. In addition, you and / or the Customer may not use the Portal in insecure environments (such as internet cafes).
If you and / or the Client know or suspect that third parties are, or may become, information concerning the user name or password or that these have been lost, stolen or missing, you and / or the Customer must immediately inform BDO.
If necessary for the proper functioning of the Global Portal, the password (s) of the client user may be reset from time to time.
If BDO grants the Client access to the Portal, the Client obtains a limited, non-exclusive and non-transferable right to use the Portal.
The Client's access to this Portal and therefore the right to use this Portal apply for the duration of the Undertaking, unless the parties agree that BDO will make the Portal available for a longer period with or without modification of its form and its content.
BDO has the right to terminate or postpone prematurely for an indefinite period, at any time, with immediate effect and without notice, the access of the Client and of the Client's Users to and therefore its right to use all or part of the Portal, for maintenance, adjustment or improvement purposes or in connection with events threatening the security of the Portal.
Upon termination of the right to use the Portal and at the express request of the Customer, BDO will restore the information and data available to the Customer on this Portal, unless and insofar as the information and data do not apply specifically to the Customer or User Client.
Upon termination of the right to use the Portal, BDO will destroy the Customer's information and data, unless BDO needs the information and data to perform the assignment or to comply with its legal or professional obligations with regard to custody or other obligations.
Third
BDO may engage service providers and / or third parties in order to feed and maintain the Portal. Insofar as third parties under contract may need to have access to the Global Portal and possibly to information from the Client or from Client users, you and the Client agree to the processing of your data and data for these purposes. You and the Customer hereby authorize BDO and the aforementioned service providers and / or third parties which BDO has used to process all the data provided. If the Customer must obtain the authorization of other parties for the processing of any data, the Customer guarantees that he has such authorization
Responsibility, compensation
Although we take commercially reasonable steps to make this Portal useful and secure, this Portal (including all Portal technology, portal content and all other content) is provided as is, without warranty of any kind. Without limiting the foregoing, we do not guarantee that this Portal will be secure, error-free, virus or malware-free, or meet specific performance or quality criteria, and we expressly disclaim all implied warranties, including warranties of merchantability, title and fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
BDO is only liable for direct damage or costs incurred due to a deliberate intention to cause damage, deception, fraud or willful recklessness on the part of staff of BDO member companies.
Your use and use by the Customer of this Portal is at your own risk and you assume full responsibility and risk of loss resulting from your use, including with regard to loss of service or data. BDO is not responsible for the existence of a point-to-point operational connection between the systems and software owned or used by the Client and the Global Portal or the platform on which the Global Portal operates.
If the Customer uses the single authentication functionality to connect to software applications owned or licensed (paid or free license) to the Customer, BDO is in no way responsible and / or responsible for the content and / or the use of the software, software packages or data in question.
Except as stipulated above, BDO is not responsible for any loss of turnover, profit or customers for any reason whatsoever, even if BDO has been informed of the probability of this loss. BDO will endeavor to repair the malfunctions reported to BDO by you and / or the Customer, unless the cause of the malfunction is attributable to you and / or the Customer or to the system and / or software used by you and / or the Customer. If you and / or the Client act in breach of obligations arising out of or in connection with the use of the Global Portal, you and / or the Client will be liable for all resulting damages and costs incurred by BDO.
The Customer indemnifies BDO against all third party claims arising out of or in connection with the Portal, including, but not limited to, third party claims arising from non-performance by the Client or persons working at or for the Client of one of the obligations applicable to them.
The above limitations of liability apply not only to us, but also to each other entity in the BDO network and to our respective staff.
If any of the above limitations of liability is invalid or unenforceable in any jurisdiction whatsoever, (i) in that jurisdiction, it will be reinterpreted to the maximum effect permitted by law to fulfill its intention as closely as possible and the other terms will remain in force and in force, and (ii) in all other jurisdictions, all these conditions will remain in force and in full effect.
Intellectual property
BDO or the third party from which BDO has obtained permits / licenses will at all times remain the owner of all intellectual and other property rights relating to this Portal.
You or the Customer may not publish information relating to the Portal or operate or use the Portal in any way whatsoever with the help of third parties or alone (including, but not limited to, storage or reproduction of all or part of the Portal on another Internet page or by inserting links, hyperlinks or deep links between the Portal and any other Internet page) for which no prior written authorization has been obtained from BDO.
Force majeure
BDO is not obliged to comply with any obligation which it is unable to meet due to force majeure. Force majeure includes failures of third parties engaged by BDO as well as disturbances or failures of the power supply and / or telecommunications systems.
Property rights
You can create a link to this Portal provided that this link does not imply unauthorized use of the Portal or our logos; any false statement (actual or implied) of approval by BDO or any other relationship with BDO; or any other violation of our trademarks, copyrights and / or other intellectual property rights.

The use of login data for the Portal provides sufficient proof of the identity of the authorized user.
Applicable law
These conditions are governed by and interpreted in accordance with the laws of the country where the head office of the BDO member company which has granted you access to the Portal is located. The courts of this country will have sole jurisdiction to resolve any dispute arising from these conditions.
